However, such a dismissal does not preclude action under another provision of the University’s Student or Employee Code.
大学可以驳回正式投诉或其中的任何指控, if at any time during the investigation or hearing: A Complainant notifies the Title IX Coordinator in writing that the Complainant would like to withdraw the formal complaint or any allegations therein; the Respondent is no longer enrolled or employed by the University; or specific circumstances prevent the University from gathering evidence sufficient to reach a determination as to the Formal Complaint or allegations therein.

Intake Meeting
有或没有正式投诉, the Title IX Coordinator must promptly contact the Complainant to discuss the availability of Supportive Measures, 考虑投诉人对支持性措施的意愿, 并向投诉人解释提出正式投诉的程序.
收到正式投诉后, the Title IX Team will conduct an Intake Meeting with the Complainant as soon as possible. At that meeting, 协调员或副协调员将讨论下列主题, as appropriate:

At the Intake Meeting, the Coordinator or Deputy Coordinator will provide the Complainant with the above-listed information in writing. 如果最初的接收会议由副协调员主持, 会议报告将提交协调员审议. As described in the Sexual Misconduct Policy, 投诉人有权要求第九条办公室不要与被投诉人共享投诉人的姓名(或其他可识别信息), 或者第九条办公室没有对该报告采取正式行动.

没有上述保密要求, the Coordinator or Deputy Coordinator will ask the Complainant questions to get a basic understanding of the reported Prohibited Conduct. The interview will include, but is not limited to, questions to understand the key facts upon which the Complainant bases the report (i.e.(谁,什么,在哪里,什么时候)适当地评估如何进行. 在吸纳会议结束时, 如果当事人想提出正式投诉, 协调员和副协调员将决定:

The Complainant and the Respondent are each permitted to select an Advisor to accompany his/her during any investigative meeting, pre-hearing conference and/or at any time following the filing of a formal complaint. - Attend any meeting or hearing with the respective Complainant or Respondent regarding the case, if invited by the respective Complainant Respondent;

在与被告会面之前, the University will provide written notice to the Respondent of the allegations of sexual harassment including sufficient details known at the time and with sufficient time to prepare a response before any initial interview. 此外,必须以书面形式向答辩人提供以下资料:

Initial Fact-Gathering:

Informal Resolution
If the Coordinator determines that it is appropriate, 双方可选择通过非正式决议解决投诉. Formal Resolution

- Complainant’s name;

- The University’s policy prohibiting retaliation
The Investigator will continue the investigation once the 3 business days has expired, 或者如果双方都作出回应,时间会更早. The Investigator, 与协调员协商, will establish an expected, reasonable timeframe for the Formal Investigation process and notify the Parties of any delays.
Formal Investigation

The burden of gathering evidence sufficient to reach a determination regarding responsibility rests on the University and not on the Parties. The standard for determining each factual finding is the “preponderance of the evidence,” (i.e.(事实的发现很可能是正确的). The Investigator will not state ultimate findings as to whether the Respondent has, or has not, violated one or more of the University’s policies. Final Report
